CRAFT Strategies– Terms of Use

Date Last Modified: October 17, 2025

These Terms of Use (the “Agreement”) are a binding contract between CRAFT Strategies, LLC (“CRAFT,” “we,” “us,” or “our”) and the individual or entity that creates an account, purchases, enrolls in, accesses, or uses any course, membership, community, digital download, or related service offered through our learning management system hosted on Thinkific (collectively, the “CRAFT Strategies” or the “Services”). By accessing or using the Services, you agree to be bound by this Agreement.

If you do not agree, do not access or use the Services.

If you accept on behalf of a company, organization, or other entity, you represent that you are authorized to bind that entity, and “you” includes that entity.

Important Notices

  • Section 1 specifies that you must be at least 21 years of age to access or use the Services.
  • Section 14 contains a class-action waiver and venue selection (Texas courts, McLennan County).
  • Section 17 describes automatic renewal for subscriptions/memberships if you opt in.
  • Courses and materials are for education only and are not legal advice nor a government license (Section 7).

1) Eligibility & Accounts

You must be at least 21 years old and able to form a binding contract under applicable law to access or use the Services. By enrolling in or accessing any CRAFT course or membership, you represent and warrant that you are 21 years of age or older.
Our programs are designed for individuals employed or seeking employment in age-restricted industries and are not intended for minors.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Do not share your login. Notify us immediately of any unauthorized use.

2) License & Access Window

Subject to this Agreement and full payment, CRAFT grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access the specific course(s) or membership(s) you purchased through the CRAFT Strategies for your own personal or internal business use.
Each course or membership will show its access period on the checkout page or in your dashboard (for example, a specific number of days, or access while your subscription remains active).

3) Prohibited Uses

You agree not to:

  • copy, download, scrape, record, mirror, or redistribute courses, videos, quizzes, PDFs, templates, question banks, images, or any part of the Services (except where expressly permitted, e.g., a clearly provided downloadable file);
  • share access, sell, rent, or otherwise transfer seats or credentials;
  • reverse engineer or test the platform’s security;
  • use the Services to violate law, infringe IP, defame, harass, or spam;
  • circumvent any access controls, DRM, or enrollment gates;
  • use our marks or “CRAFT Verified” brand elements without written permission.

4) Ownership & Intellectual Property

All content in the Services—including text, video, audio, images, question banks, templates, checklists, SOPs, badges, and “CRAFT Certified" and/ or "CRAFT Verified” marks—is owned by CRAFT or our licensors and protected by intellectual-property laws. You receive a license to use, not ownership of, the content. We reserve all rights not expressly granted.

If you submit or post content (e.g., assignments, comments, reviews, forum posts), you grant CRAFT a worldwide, royalty-free license to host, display, and use that content to operate and improve the Services. You represent you have the necessary rights to grant this license.

5) Academic Integrity & Badges

You must complete coursework honestly. Cheating, sharing answers, or using unauthorized aids may result in removal or denial of a certificate/badge without refund. We may require identity checks, proctoring, or re-assessment.

6) Teams, Enterprise & Seat Transfers

If your organization purchases multiple seats, each seat is for one named learner. Seat transfers may be allowed before a learner begins a course; once a learner starts, the seat is locked to that learner. Any different terms in a signed enterprise agreement will control.

7) Education Only (No Legal Advice; No Government License)

CRAFT courses are educational and general-information resources. They are not legal, regulatory, or compliance advice, and do not replace professional counsel. Completion of a course and issuance of a certificate or digital badge does not grant you a government license, registration, exemption, or permission to sell or handle regulated products. You are solely responsible for complying with all applicable laws and regulations.

8) Platform & Third-Party Services

CRAFT Strategies is delivered via Thinkific and may link or integrate with other third-party services (video hosting, payment processors, webinar tools, etc.). Those services are governed by their own terms and privacy policies. CRAFT is not responsible for third-party acts or omissions.

9) Availability; Updates; Changes

We may modify, suspend, or discontinue any course, module, exam, community feature, or downloadable at any time (for example, to keep content current with regulations). We may update content without notice. If a course you purchased is materially discontinued during your stated access window, we’ll provide a commercially reasonable alternative or pro-rata remedy at our discretion.

10) Pricing, Taxes & Payments

Prices are shown at checkout and may change prospectively. You authorize us (and our payment processor) to charge your selected payment method for purchases, subscriptions, taxes, and applicable fees. You are responsible for any sales/use/VAT/GST or similar taxes unless we collect them at checkout.

11) Refunds & Cancellations

Unless a different policy is shown on the specific product page at checkout, our default policy is:

  • Single-course enrollments: refund requests within 7 days of purchase and before completion of more than 20% of the course content (whichever comes first).
  • Memberships/subscriptions: you can cancel at any time; cancellations take effect at the end of the current billing period and are not retroactive. No proration unless required by law.
  • Bundles, downloads, templates, exams, live sessions, and events may be non-refundable once delivered or after the registration cutoff stated on the product page.
    Chargebacks without first contacting support may result in account suspension. To request a refund or cancel, follow the instructions in your account or contact [email protected].

12) Privacy

Our collection and use of personal data is described in our Privacy Policy (link from site footer). By using the Services, you consent to those practices, including processing by our platform and service providers.

13) Accessibility & Accommodations

CRAFT strives to make training accessible. If you need a reasonable accommodation (e.g., extended time, alternative formats), contact [email protected] before you begin an assessment so we can work with you.

14) Dispute Resolution; Class-Action Waiver; Governing Law

14.1 Class-Action Waiver. You agree not to bring or participate in any class, collective, or representative action against CRAFT; only individual claims are permitted.
14.2 Venue & Law. Any dispute arising from or relating to this Agreement or the Services shall be brought exclusively in state or federal courts located in McLennan County, Texas, and governed by the laws of the State of Texas (without regard to conflict-of-law rules). You consent to personal jurisdiction and waive objections to venue.
14.3 Time Limit. Any claim must be filed within two (2) years after it arose or be forever barred, unless a shorter limitations period applies by law.

15) Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CRAFT AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. We do not guarantee uninterrupted or error-free operation or outcomes.

16) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) CRAFT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR SUBSTITUTE SERVICES); AND (B) CRAFT’S TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO CRAFT FOR THE PRODUCT OR MEMBERSHIP GIVING RISE TO THE CLAIM. MULTIPLE CLAIMS DO NOT INCREASE THIS LIMIT.

17) Automatic Renewal (Subscriptions/Memberships)

If you purchase a subscription or membership with auto-renewal, you authorize recurring charges to your payment method at the then-current rate and cadence (e.g., monthly/annual) until you cancel. You can cancel any time before the renewal date via your account settings. Upon cancellation, access continues through the end of the paid term; no future charges will process.

18) Suspension & Termination

We may suspend or terminate access (with or without notice) for suspected or actual violations of this Agreement, fraud, nonpayment, abuse, or to protect our users or the platform. You may stop using the Services at any time. Sections that by their nature should survive (including 4, 7, 10–16, 18–21) will survive termination.

19) DMCA & Complaints

If you believe content in the Services infringes your copyright, send a notice with: (a) your contact info; (b) a description of the work; (c) the specific URL or location; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that your notice is accurate and you are authorized; and (f) your physical or electronic signature.

21) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., outages, cyber incidents, acts of God, law/policy changes, labor issues, disasters).

22) Changes to These Terms

We may update these Terms prospectively by posting the revised version with a new “Date Last Modified.” Material changes may also be communicated by email or in-app notice. Your continued use after changes are posted constitutes acceptance.

23) Miscellaneous

This Agreement (plus any product-specific terms shown at checkout) is the entire agreement between you and CRAFT regarding the Services and supersedes prior understandings.
